Shadow transport rental: the ESBU liquidated a tax evasion scheme

 Two companies from the Kyiv region engaged in international transportation completely returned over UAH 10 million in caused damages to the state budget.

Detectives of the Territorial Office of the ESBU in the Kyiv region established that the entrepreneurs deliberately avoided full payment of mandatory fees, namely personal income tax and military tax, during rental payments for transport to individuals.

Analysts of the Bureau thoroughly studied the economic activity of the firms and exposed a scheme to minimize tax obligations. The inspection showed that during the payment of money for rent, the company heads ignored the requirements of the legislation and "forgot" to transfer the personal income tax and military tax.

As a result of such concealment of real income, each of the enterprises underpaid over UAH 5 million to the state budget, and the total amount reached over 10 million UAH.

On the basis of the collected evidence, ESBU detectives notified the suspects of suspicion under Part 1 of Article 212 of the Criminal Code of Ukraine.

During the pretrial investigation, the entrepreneurs fully reimbursed the damages caused to the state. Over 10 million UAH of unpaid taxes were paid to the budget.

In connection with the full reimbursement of the caused damages to the state, the prosecutor applied to the court with a motion to release the person from criminal liability in accordance with the requirements of Part 4 of Article 212 of the Criminal Code of Ukraine.
