Attestation of the ESBU Employees

 According to the Law of Ukraine “On Amendments to Certain Legislative Acts of Ukraine on Improving the Work of the Economic Security Bureau of Ukraine” (hereinafter – the Law), in order to confirm the proper level of integrity and professional competence, the employees of the Economic Security Bureau of Ukraine are subject to a one-time attestation (hereinafter – attestation).

Attestation is carried out by attestation commissions established by decision of the Director of the ESBU.

Each attestation commission consists of 12 members, including:

  • six persons appointed by the Director of the ESBU;
  • six persons designated by international and foreign organizations which, in accordance with international or interstate agreements, during the last three years have provided international technical assistance to Ukraine in the field of preventing and combating corruption and/or reforming law enforcement bodies, from among representatives selected by them from public associations, unions, professional associations, and other associations of legal entities, which during the last three years have been carrying out activities aimed at improving the business climate and protecting the rights and interests of business in Ukraine.

The list of such international and foreign organizations is provided by the Ministry of Foreign Affairs of Ukraine at the request of the Director of the ESBU. The said international and foreign organizations shall agree on the proposal of a joint list of candidates for inclusion in the attestation commission.

The list of international and foreign organizations submitted by the Ministry of Foreign Affairs of Ukraine at the request of the Director of the ESBU includes:

  • the European Union (Delegation of the European Union to Ukraine);
  • the European Union Advisory Mission to Ukraine;
  • the United States Department of State / Bureau of International Narcotics and Law Enforcement Affairs;
  • the United States Agency for International Development (USAID);
  • the Council of Europe (Council of Europe Office in Ukraine);
  • the Organization for Security and Co-operation in Europe (Special Representative of the Chairperson-in-Office — OSCE Project Co-ordinator in Ukraine);
  • the Swiss Agency for Development and Cooperation of the Federal Department of Foreign Affairs of Switzerland;
  • the Ministry of Foreign Affairs of the Kingdom of the Netherlands.

Taking into account the significant number of employees subject to attestation (1,277 persons), as well as the limited timeframe established by the Law for its implementation (approximately 15 months), the ESBU plans to establish at least 4 attestation commissions.

For the prompt formation of the attestation commissions, the ESBU has addressed the international and foreign organizations included in the list submitted by the Ministry of Foreign Affairs of Ukraine with a request to delegate 24 candidates for the formation of attestation commissions.
