List of information constituting official information in the Economic Security Bureau of Ukraine*

1. In the field of operational-search activities and pre-trial investigation

1.1. Information regarding the organization and conduct of covert search and counterintelligence measures carried out using operational and operational-technical means, except for information classified as state secrets.

1.2. Information regarding the organization and conduct of covert investigative (search) actions, except for information classified as state secrets.

1.3. Information regarding the implementation of confidential cooperation with natural persons (individuals), except for information classified as state secrets.

1.4. Information obtained during the conduct of operational-search activities, except for information classified as state secrets.

1.5. Letters, certificates, conclusions, and other documents (including intra-agency documents) prepared by executors, which contain information not constituting a state secret, but the disclosure of which may cause significant harm to the interests of national security, territorial integrity, or public order, lead to the disclosure of confidential information, facilitate unrest, or the commission of crimes, etc.

1.6. Information on the processing and review of summarized (additional summarized) materials, based on which it is possible to directly or indirectly identify enterprises, participating individuals, financial transactions, or establish the fact that financial monitoring is being conducted regarding them.

1.7. Information regarding the methods, means, and procedures for organizing, planning, and conducting investigative (search) actions in criminal proceedings concerning offenses falling under the investigative jurisdiction of the ESBU detectives.

2. In the field of protection of state secrets and technical protection information

2.1. In the field of protection of state secrets:

2.1.1. Information regarding the organization and actual state of ensuring the protection of state secrets, except for information classified as state secrets.

2.1.2. Information regarding the results of internal service checks (investigations) concerning the disclosure of state secrets, loss of material carriers of secret information, and other violations of the secrecy regime, norms, and requirements for technical information protection, except for information classified as state secrets.

2.1.3. Information about the security system, internal facility regime, and technical equipment of restricted access facilities, zones, territories, and premises where work related to state secrets is conducted, provided that information classified as state secrets is not disclosed.

2.1.4. Information regarding the inspection of restricted access premises (zones, territories, etc.) for suitability to conduct secret work, reflected in the inspection (re-inspection) reports, lists of restricted access premises, etc.

2.1.5. Information regarding the schemes for the location of storage sites, and the procedures and routes for the transportation (delivery) of material carriers of secret information.

2.1.6. Information regarding the grounds for classifying information as a state secret, the substantiation of the threat level, and the description of the harm to the national security (national interests) of Ukraine in case of its non-classification as a state secret or disclosure, contained in the decisions and expert opinions of the state expert on secrets, and in the protocols of the expert commission under the state expert on secrets.

2.1.7. Information regarding the material carriers of secret information, which is contained in the nomenclature of secret files, descriptions, forms of their accounting (registration), lists, reports of verification of availability, review of secrecy classifications, destruction, acceptance and transfer, etc., and does not contain information classified as state secrets.

2.1.8. Summarized information on the procedure and results of the transfer of material carriers of secret information in the event of a change in the head of the secrecy-regime body, or the reorganization or liquidation of the ESBU secrecy-regime body.

2.1.9. Information regarding the material carriers of secret information contained in the protocols and acts of the expert commissions on secrets, and the expert commission for conducting the expertise of the value of secret documents, which does not constitute a state secret.

2.1.10. Information regarding measures to ensure the secrecy regime under conditions of a special period or a legal regime of emergency situation, as well as in case of a threat of seizure of material carriers of secret information.

2.1.11. Information regarding the nomenclature of positions of the ESBU employees, the occupation of which requires permission for and access to state secrets.

2.1.12. Information regarding the permission for and access to state secrets by the ESBU employees, including information about their position, the form of permission, the degree of secrecy of the information to which access is granted, which is contained in registration forms, records, cards, orders on granting / terminating access to state secrets, as well as on establishing / canceling additional payments / allowances for work involving access to state secrets for the ESBU employees.

2.2. In the field of technical protection of information:

2.2.1. Information regarding the categorization and inspection of the ESBU information activity facilities (electronic computing equipment facilities), and the creation, testing, and pilot operation of integrated information protection systems within information, electronic communication, or information-communication systems (automated systems) where protectable information circulates.

2.2.2. Information concerning the aggregate of all component indicators regarding the requirements (recommendations) for ensuring the technical protection of confidential and official information that circulates at a specific the ESBU information activity facility or is processed in a specific information, electronic communication, or information-communication system (automated system) of the ESBU.

2.2.3. Information regarding individual indicators of the placement and structure of the ESBU information activity facilities where restricted-access information circulates (site and master plans, diagrams of the placement and routing of cable lines, the content of measures, and the composition of technical information protection means, etc.), except for information classified as state secrets.

2.2.4. Information regarding the procedure for the manufacture, accounting, and storage of passwords, keys, and identifiers used in the ESBU information-communication (automated) systems where open information and/or restricted-access information is processed.

2.2.5. Information regarding the technical means used for processing restricted-access information, and the procedure for their protection and evacuation.

2.2.6. Information regarding the results of state expert reviews in the field of technical information protection of integrated information protection systems within the ESBU information, electronic communication, or information-communication systems (automated systems) where protectable information circulates, conducted through expert testing or analysis of the declaration of conformity of the integrated information protection systems to the requirements of regulatory documents on technical information protection.

2.2.7. Information regarding the technical characteristics (specifications) or specific application features of means for technical information protection and counteraction to technical intelligence that will be used at the ESBU information activity facilities.

2.2.8. Information regarding the planning and implementation of measures, the actual state, and the presence of deficiencies in the organization of technical information protection generally across the ESBU, except for information classified as state secrets.

2.2.9. Information regarding the results of expert testing of integrated information protection systems within the ESBU information, electronic communication, or information-communication systems (automated systems) for compliance with the requirements of regulatory legal acts on technical information protection, except for information classified as state secrets.

2.2.10. List of technical means used for instrumental control of the security of the ESBU information activity facilities against information leakage through technical channels.

2.2.11. Information stored on the identifiers of complexes of means for protecting information from unauthorized access, except for information classified as state secrets.

2.2.12. Information security measures at the ESBU facilities where restricted-access information circulates, except for information classified as state secrets.

2.2.13. Information regarding the results of checks on the state of technical information protection, except for information classified as state secrets.

2.2.14. Information regarding the means and measures of information protection in restricted areas, in information-telecommunication and computer networks, and in restricted access premises of the ESBU, except for information classified as state secrets.

2.2.15. Information regarding the conditions of placement of information activity facilities relative to foreign representations, except for information classified as state secrets.

3. Personnel Management

3.1. Information contained in the protocols and conclusions of the ESBU disciplinary commission. Information contained in the materials of the internal service investigation (case) after the approval of the conclusion of the ESBU disciplinary commission.

3.2. Information regarding the positions and personal data of persons holding special the ESBU ranks (except for the heads and deputy heads of the ESBU Territorial Offices), their affiliation with internal security units, operational support units, units conducting operational-search activities and pre-trial investigation, and units performing information-search and analytical-information work.

3.3. Information regarding the service history of persons holding special the ESBU ranks (appointment, dismissal, etc., including extracts from service records).

3.4. Information regarding prior service in positions related to the conduct of operational-search activities, in units authorized to carry out operational-technical measures, special forces units, and units performing information-search and analytical-information work.

3.5. Information regarding internal security units, operational support units, units conducting operational-search activities and pre-trial investigation, units performing information-search and analytical-information work, as well as information regarding structural units that include positions held by persons with special the ESBU ranks, contained in the regulations on such units and job descriptions / official duties of employees of such units.

3.6. Information regarding the affiliation of the ESBU employees to operational-technical units, except for information classified as state secrets.

4. Organizational and administrative activities

4.1. Information constituting official information, contained in the materials of hardware meetings, meetings, sessions of the ESBU Board, commissions, and working groups (protocols, reports, decisions, service notes, etc.).

4.2. Normative and administrative documents on issues containing official information, except for information classified as state secrets.

4.3. Work plans of internal security structural units, secrecy-regime units, and units conducting operational-search activities, except for information classified as state secrets.

5. Financial and resource support

5.1. Information regarding the financial support of the ESBU operational-search activities.

5.2. The procedure and results of control measures concerning the execution of the budget program under CPCE 6491010 "Leadership and management in the field of economic security" in the part of financial support for the ESBU operational-search activities.

5.3. Information regarding the accounting of armaments and special equipment (means) in the ESBU.

5.4. Information regarding the types and quantity of departmental firearms, ammunition for them, and special equipment (means) that are registered and stored in the ESBU and in the weapons storage rooms.

5.5. Information regarding the location, storage procedure, transportation (transit) routes, and preservation measures for armaments, ammunition, and special equipment (means), except for information classified as state secrets.

5.6. Information containing details regarding special (specialized) vehicles and the ESBU employees to whom such vehicles are assigned, except for information classified as state secrets.

5.7. Information contained in the acts of acceptance and transfer of documents, property, and other material assets of the ESBU that are classified as official information.

5.8. Information regarding the existing video surveillance system in the ESBU bodies, the location of its elements, and the list of persons who have access to it.

5.9. Information regarding the existing access control system in ESBU bodies, the location of its elements, and the list of persons who have access to it.

6. Anti-сorruption activities

6.1. Information contained in the materials regarding the implementation of protection measures for whistleblowers who report unlawful actions or inactions by other the ESBU employees.

6.2. Declarations of a person authorized to perform state or local self-government functions, notifications of significant changes in the financial status of the declarant, and notifications of opening a foreign currency account in a non-resident bank institution by the declarant or a member of their family, submitted by declarants subject to Article 52¹ of the Law of Ukraine "On Prevention of Corruption," except for information classified as state secrets.

6.3. Information contained in the materials of integrity checks of the ESBU employees and monitoring of their lifestyle.

7. Mobilization work

7.1. Information regarding mobilization preparedness measures, and the mobilization plan of the ESBU and its Territorial Offices.

7.2. Information set forth in methodological materials on mobilization preparedness issues.

7.3. Information on the implementation of laws and other regulatory legal acts regarding mobilization preparedness.

7.4. Information on military conscripts reserved (exempted from immediate call-up) for the ESBU and its Territorial Offices.

7.5. Information on measures provided to ensure the effective functioning of the ESBU and its Territorial Offices under conditions of a special period.

7.6. Information on the state of mobilization readiness of the ESBU and its Territorial Offices.

7.7. Information on the organization of notification, command, and communication, and the procedure for transferring the ESBU and its Territorial Offices to the operating regime under conditions of a special period, excluding those that constitute a state secret.

7.8. Information on long-term and annual mobilization preparedness programs of the ESBU and its Territorial Offices.

7.11. Information on the number of military conscripts and equipment that are registered for military service, designated for staffing the Armed Forces of Ukraine and other military formations.

7.13. Information regarding the ESBU employee conscripts called up for military service during mobilization to the Armed Forces of Ukraine and other military formations.

7.14. Information regarding the allocation of buildings, structures, land plots, transport, and other material and technical resources to the Armed Forces of Ukraine and other military formations during a special period.

8. Internal security and protection of the ESBU employees

8.1. Information regarding the organization and implementation of protection measures for the ESBU employees, as well as members of their families, excluding information that constitutes a state secret.

8.2. Information regarding the development of measures to counteract unlawful and provocative actions against the ESBU employees in connection with the performance of their official duties, as well as members of their families, excluding information that constitutes a state secret.

8.3. Information regarding the forms and methods of conducting operational-technical inspections of the places of permanent and temporary stay of protected persons.

8.4. Information about enterprises, institutions, and organizations, regardless of ownership, against which the ESBU operational-search measures are being conducted, excluding information that constitutes a state secret.

8.5. Information regarding the activities of covert enterprises (legendirovannyh predpriyaty, i.e., shell or cover companies), excluding information that constitutes a state secret.

8.6. Information regarding the equipment of official and restricted access premises of the administrative buildings of the ESBU and its Territorial Offices, excluding information that constitutes a state secret.

8.7. Information regarding the codes (passwords) for arming (disarming) facilities, the schematic diagrams of their equipment and blocking with security-fire and panic alarm means, and the methods of disabling these means.

8.8. Information regarding specialized software, information exchange protocols, and communication lines, including those between the components of the alarm transmission systems in the security system of official and restricted access premises of the administrative buildings of the ESBU and its Territorial Offices.

9. Civil protection

9.1. Information regarding civil protection by specific indicators concerning the deployment (actual location address), functioning, and characteristics of concrete (urban, reserve suburban) command points.

9.2. Information regarding the organization of warning (notification) or communication in the field of civil protection for a special period, under conditions of a state of emergency, or in the event of a threat or commission of terrorist acts against the central executive body.

9.3. Information regarding the standards, measures, tasks, and planning of civil protection measures.

9.4. Information regarding the procedure for actions of the ESBU employees in case of the announcement of civil protection warning signals and the activation of response plans for man-made and natural emergencies.

9.5. Information regarding the procedure for actions of the ESBU employees in case of the activation of the civil protection plan for a special period, and the transfer of the ESBU units to the appropriate degrees of readiness, excluding information that constitutes a state secret.

10. Cryptographic information protection

10.1. Information (by individual indicators) regarding the content, status, presence of deficiencies in the organization or security provision, plans for the development of the cryptographic information protection system in the ESBU, the procedure for the application of cryptographic information protection means, and the results of the operation of these means, excluding those that constitute a state secret.

10.2. Information regarding the existing and prospective systems and complexes of special communications that are applied or planned for application in the ESBU.

10.3. Information regarding the content of measures, status, and planning concerning the organization and security provision of special types of communication, if this information does not constitute a state secret.

10.4. Information by individual indicators regarding the procedure for the accounting, use, and handling of cryptographic protection means for official information and their key documents, as well as the transfer (forwarding) of these means, key documents, and regulatory, technical, and operational documentation.

10.5. Information by individual indicators regarding the nomenclature, quantity, and tactical and technical characteristics of technical means used in government or special communication networks or complexes, excluding those that constitute a state secret.

10.6. Information regarding cryptographic systems or cryptographic protection means for official information, if they disclose their cryptographic scheme (protection scheme, principles of construction, or cryptographic parameters).

10.7. Information regarding the nomenclature, quantity of cryptographic protection means for official information, and their location.

10.8. Information (by individual indicators) regarding the content, status, presence of deficiencies in the organization or security provision of the cryptographic protection system for official information, the procedure for the application (operation) of cryptographic protection means for official information, and the results of the operation of these means.

10.9. Information regarding the interaction of the ESBU with state authorities, enterprises, institutions, and organizations in the field of cryptographic protection of official and secret information, if this information does not constitute a state secret.

10.10. Information regarding the procedure for use, handling, technical characteristics of key documents, and the content of key data for cryptographic protection means of official information.

10.11. Information regarding the nomenclature and tactical and technical characteristics of cryptographic protection means for secret information, if this information does not constitute a state secret.

10.12. Information (content, structure, and full title) regarding regulatory legal acts and normative documents on the issues of cryptographic protection of secret and official information, if this information does not constitute a state secret.

10.13. Information regarding the status, planning, organization, and implementation of departmental control over the state of cryptographic protection of restricted-access information, the requirement for the protection of which is established by law, if this information does not constitute a state secret.

10.14. Information regarding the provision of special communications to the ESBU officials, the installation and/or removal of special communication subscriber equipment, as well as information contained in directories, lists, and subscriber lists of special communications.

10.15. Information by individual indicators on issues of ensuring the security of government and special types of communication, if they do not disclose the norms (requirements) and methods of control for the technical protection of information, excluding those that constitute a state secret.

10.16. Information regarding the planning, organization, and execution of work by personnel with cryptographic protection means for secret information, key documents, and ciphers, as well as the granting (revocation) of access to cipher work, if this information does not constitute a state secret.

10.17. Information regarding the positions that require the granting of access to ciphers.

10.18. Information regarding specific sections of the routes of government or special communication channels or cables (lines), excluding information that constitutes a state secret.

10.19. Information regarding the state of special communication security in the ESBU, excluding those that constitute a state secret.

10.20. Information that reveals the content of measures for monitoring the security of special communication in the ESBU.

10.21. Information regarding communication security breaches that lead to the disclosure of restricted-access information.

11. Information and analytical activities

11.1. Analytical products of the ESBU (in cases where they use information constituting official information).

11.2. Information documents of the ESBU (in cases where they use information constituting official information).

11.3. Indicators (markers) of risks for the commission of criminal offenses.

11.4. Information contained in letters and recommendations that does not constitute a state secret, but the disclosure of which may cause harm to the interests of national security and/or territorial integrity.

11.5. Information contained in letters and recommendations on sanction policy from the moment of preparing proposals regarding the application of personal special economic and other restrictive measures (sanctions) until their entry into force by a Decree of the President of Ukraine based on a decision of the National Security and Defense Council of Ukraine.
