The head of an extractive enterprise in the Vinnytsia region, who for a long time understated extraction volumes and artificially inflated expenses, fully reimbursed the damages caused to the state. Thanks to the work of detectives of the Economic Security Bureau of Ukraine, the entire amount of unpaid taxes entered the budget.
During the pretrial investigation, it was established that during 2023–2026, the director of the company formed a groundless VAT tax credit, distorted data on extraction volumes to reduce the rent for subsoil use for mineral extraction, and also artificially formed the enterprise's expenses. This led to the non-receipt of taxes into the budgets for a total amount of over 4.5 mln UAH.
The head of the enterprise was notified of suspicion of committing a criminal offense provided for by Part 1 of Article 212 of the Criminal Code of Ukraine—intentional tax evasion in significant amounts. During the pretrial investigation, he fully reimbursed the damages caused to the state. Therefore, the proceedings have been forwarded to court with a motion to release the suspect from criminal liability.
Procedural guidance was carried out by the Vinnytsia Regional Prosecutor's Office.
According to Article 62 of the Constitution of Ukraine, a person is considered innocent of committing a crime and cannot be subjected to criminal punishment until their guilt is proven in accordance with the law and established by a court verdict.
