Regime-Secret Sector


Main tasks:

1) timely development and implementation, in cooperation with other structural units of the TO of the ESBU in the Kyiv region, of measures for the protection of state secrets; exercising control over the status of the secrecy regime;

2) preventing unauthorized security clearance and access of individuals to classified information;

3) identifying and closing channels of classified information leakage during the operations of the TO of the ESBU in the Kyiv region;

4) organizing and participating, in accordance with the established procedure, in internal investigations into facts of classified information leakage, as well as other violations of legislative requirements in the field of state secrets protection; maintaining records and conducting analysis of these facts and operations;

5) ensuring the secrecy regime during the execution of all types of classified work.

Main functions:

1. Organizes the provision of state secrets protection and control over its observance within the TO of the ESBU in the Kyiv region.

2. Develops, based on legislative requirements, and implements, in cooperation with other structural units of the TO of the ESBU in the Kyiv region, measures for the protection of state secrets during all types of classified work, the use of classified documents, products, and other material carriers of classified information, as well as during visits to the TO of the ESBU in the Kyiv region by foreign delegations, groups, or individual foreigners.

3. Organizes and conducts the management of classified clerical operations and the storage of classified documents:1) keeping track of prepared documents; 2) keeping track of incoming documents; 3) keeping track of packages;4) keeping inventory track of written bound materials; 5) keeping track of working logs, special notebooks, internal indexes, personal accounts, individual sheets, and blanks (forms); 6) keeping track of material carriers of classified information in archival storage; 7) keeping track of classified regulatory documents; 8) keeping track of machine-readable carriers of classified information; 9) producing and tracking copies of classified documents and extracts from them; 10) dispatching material carriers of classified information (hereinafter referred to as MCCIs); 11) ensuring the compilation of the nomenclature of classified case files; 12) forming, tracking, and storing classified case files; 13) keeping track of and forming case file volumes containing materials from covert investigative (search) actions in criminal proceedings; 14) preparing and transferring classified documents to archival storage; 15) destroying MCCIs; 16) organizing the review of secrecy classifications of MCCIs; 17) conducting audits/inventories to verify the presence of classified documents and other MCCIs; 18) carrying out the delivery/receipt of classified documents to the Kyiv Court of Appeal, other courts, and law enforcement agencies.

4. Develops prospective (long-term) and current plans for the protection of state secrets, as well as action plans to resolve specific issues related to ensuring the secrecy regime.

5. Organizes and ensures control over the execution of classified instructions from higher-level authorities.

6. Organizes and implements the system of security clearance and access to state secrets: 1) formulating, based on proposals from the heads of structural units, the nomenclature of positions of employees at the TO of the ESBU in the Kyiv region whose roles require processing security clearances and granting access to state secrets, and maintaining it thereafter;2) processing the necessary documents for granting state secret security clearances to employees of the TO of the ESBU in the Kyiv region and monitoring the expiration dates of these clearances; 3) producing, filling out, registering, and tracking citizen accounting cards for granting security clearance and access to state secrets, and sending notifications to the SSU (Security Service of Ukraine) body using the form in accordance with Annex 8 of Procedure 939; 4) preparing orders on granting or terminating access to state secrets; 5) preparing orders on establishing or canceling compensation for working under secrecy regime restrictions; 6) verifying knowledge of the requirements of normative legal acts regarding the protection of state secrets; 7) keeping records of foreign travel by employees who have been granted security clearance to state secrets; 8) maintaining records and issuing certificates on the availability of a state secret security clearance.

7. Maintains records of MCCI storage facilities, secure rooms, and their keys, as well as individual numbered metal seals of employees who have been granted security clearance and access to state secrets.

8. Organizes, in accordance with the established procedure, internal investigations into facts of classified information leakage, as well as other violations of legislative requirements in the field of state secrets protection, and participates in them.

9. Exercises control over:1) compliance with legislative requirements in the field of state secrets protection within the TO of the ESBU in the Kyiv region, including adherence to the established procedure for handling material carriers of classified information; the status of the access control and on-site security regimes; the protection of premises (zones, territories) and storage facilities for material carriers of classified information; the timeliness and correctness of classification, modification of secrecy classifications, or declassification of material carriers of information; and the implementation of planned measures to prevent the leakage of classified information during the preparation and conduct of meetings, conferences, and exhibitions, as well as during visits to the TO of the ESBU in the Kyiv region by foreign delegations, groups, or individual foreigners, and work conducted with them; 2) compliance with the procedure established within the TO of the ESBU in the Kyiv region regarding employee access to information constituting state secrets, in connection with which it conducts audits to verify that the level of security clearance granted to employees matches the degree of secrecy of the information to which access is provided; 3) the status and organization of work related to state secrets protection within the TO of the ESBU in the Kyiv region.

10. Prepares documentation for the TO of the ESBU in the Kyiv region to obtain a special permit to conduct activities related to state secrets.

11. Conducts awareness-raising and briefing activities to prevent violations of legislation in the field of state secrets protection by officials of the TO of the ESBU in the Kyiv region who have been granted security clearance and access to state secrets, including in connection with their travel outside of Ukraine for official business trips or personal matters, as well as their participation in international events within Ukraine.

12. Organizes and supports the work of the commissions of the TO of the ESBU in the Kyiv region: 1) expert commission on secrets; 2) expert commission on the appraisal of classified documents;

 3) commission on the destruction of material carriers of classified information; 4) commission on the inspection of secure rooms; 5) commission on conducting quarterly and general audits/inventories to verify the presence of MCCIs.

13. Organizes and exercises control over the implementation of legislative regulatory acts, as well as orders of the ESBU and the TO of the ESBU in the Kyiv region regarding state secrets protection and the secrecy regime by the structural units of the TO of the ESBU in the Kyiv region.

14. Studies, analyzes, and conducts inspections of the state of operational organization within the structural units of the TO of the ESBU in the Kyiv region and the compliance of their officials with the requirements of current legislation in the field of state secrets protection.

15. Monitors the rectification of deficiencies uncovered during inspections of the state of state secrets protection and submits proposals to the leadership of the TO of the ESBU in the Kyiv region to facilitate appropriate managerial decision-making.

16. Organizes training for employees of the TO of the ESBU in the Kyiv region whose activities are related to state secrets, and verifies their knowledge of the requirements of regulatory documents regarding state secrets protection.

17. Ensures the secrecy regime and exercises control during the handling of classified documents of a mobilization nature.

18. Prepares materials for the alignment and approval of the appointment of the Head of the Secret-Regime Sector of the TO of the ESBU in the Kyiv region with the secret-regime body of the central apparatus of the BES.

19. Monitors compliance by users with the requirements for protecting information that constitutes a state secret during its processing in the automated systems of the TO of the ESBU in the Kyiv region.

20. Ensures the secrecy regime during international cooperation.

21. Provides organizational, methodological, and practical assistance to the structural units of the TO of the ESBU in the Kyiv region on matters of state secrets protection.
