Misappropriation of state hydrotechnical structures worth 22.7 million UAH: An enterprise director will stand trial in Kyiv

 The director of a private enterprise will stand trial for illegally misappropriating state hydrotechnical structures valued at over 22.7 million UAH. Detectives of the Territorial Office of the ESBU in Kyiv completed the pretrial investigation and referred the indictment to court.

The investigation established that the head of the enterprise, using his official position, organized the illegal registration of ownership rights to the hydrotechnical structures located in the capital. Forged documents were used for state registration, based on which the objects of state ownership were registered under a private company.

These are structures that ensure the performance of state functions and, according to the legislation, are not subject to privatization and cannot be in private ownership.

During the pretrial investigation, ESBU detectives took measures to protect the interests of the state. As a result, hydrotechnical structures with a total value of over 22.7 million UAH were returned to state ownership.

The actions of the accused are qualified under Part 3 of Article 206-2 of the Criminal Code of Ukraine (unlawful misappropriation of property of an enterprise, institution, or organization through the use of forged documents, which caused grave consequences). The indictment has been referred to court.

Operational support was carried out by the employees of the Main Directorate “I” of the DHSS of the Security Service of Ukraine. Procedural oversight was carried out by the Kyiv City Prosecutor's Office.

According to Article 62 of the Constitution of Ukraine, a person is presumed innocent of committing a crime and cannot be subjected to criminal punishment until their guilt is proven in accordance with the law and established by a court verdict of conviction.
