Counterfeit DURACELL batteries: the case has been forwarded to the court

 Three members of the group will stand trial for the illegal manufacture and sale of counterfeit batteries using the DURACELL trademark. The indictment has already been forwarded to court. According to the investigation, the rights holder suffered over UAH 5 million in damages.

The pre-trial investigation was initiated, in particular, following an application from the American company DURACELL BATTERIES BVBA regarding the infringement of intellectual property rights.

The investigation established that during 2024–2025, the suspects imported over 1.4 million unlabeled batteries into Ukraine. On the territory of the Lviv region, using specialized equipment, they applied trademarks and service marks of the DURACELL TM and other brands to the products, subsequently selling the counterfeit goods across Ukraine.

According to the investigation, the members of the group illegally applied the DURACELL trademark to at least 119.2 thousand batteries. As a result, the rightsholder suffered material damages exceeding UAH 5 million.

The three suspects are accused of illegal use of a trademark and service mark, which caused material damage on an especially large scale (Part 3 of Article 229 of the Criminal Code of Ukraine). Additionally, one of them is charged with smuggling goods (Part 3 of Article 201-3 of the Criminal Code of Ukraine).

The prosecution was supervised by the prosecutors of the Office of the Prosecutor General. Operational support was provided by the officers of the Department of Detectives for Strategic Economic Protection of the ESBU and the Department of Operational and Investigative Activities of the Administration of the State Border Guard Service of Ukraine.

Note: According to Article 62 of the Constitution of Ukraine, a person is presumed innocent of committing a crime until their guilt is proven in accordance with the law and established by a court verdict of guilty.
