Analysts of the Territorial Department ESBU in Zakarpattia region prevented an illegal procurement of construction works for budget funds. The initiator of the procurement was one of the education departments which planned to reconstruct a preschool education institution with the addition of new premises. Officials announced a tender for the procurement of the said works at an expected cost of UAH 40 million.

While analyzing compliance with public procurement legislation, the employeers of the ESBU found violations of the Law of Ukraine "On public procurement" and the specifics of public procurement of goods, works and services for customers provided for by the Law of Ukraine "On public procurement" for the period of martial law in Ukraine and within 90 days from the date of its termination or cancellation. Based on the results of the tender procedures, the customer unreasonably rejected the most economically advantageous offer of the participant and chose the offer with the highest cost of services.

Based on the identified prerequisites for harming the economic security of the state and to prevent embezzlement of budget funds the analysts sent a letter of recommendation to the Education department with a proposal to cancel the procurement. According to the recommendation the procuring entity canceled the procurement.

Illegal procurement of services for budgetary funds and causing damage to the territorial community is prejudicial.

Remind that detecting and investigating violations of the law in tender procurement and preventing embezzlement of budget funds is one of the priorities of the ESBU. Recently, detectives of the Territorial Department of the Economic Security Bureau in Zakarpattia region served two suspects with a notice of suspicion in a criminal proceeding over misappropriation of UAH 2.2 million provided by an international grant program for the construction of a rehabilitation center.
