Main tasks

• Organization of legal work aimed at the correct application, strict compliance, and prevention of non-compliance with the requirements of legislation, and other normative acts of TO of the ESBU in Chernivtsi region and its employees during the performance of assigned tasks and functional duties.
• Self-representation of the interests of TO of the ESBU in Chernivtsi region its officials and employees in courts without a separate mandate from the management of TO of the ESBU in Chernivtsi region as well as self-representation of the interests of ESBU (with a separate mandate) in courts.

Functions

• Organizes and participates in ensuring the correct application of legislation during the self-representation of the interests of TO of the ESBU in Chernivtsi region its officials and employees in courts without a separate mandate from the management of TO of the ESBU in Chernivtsi region and self-representation of the interests of ESBU (if there is a separate mandate) in courts.
• Develops and participates in the development of draft orders and other documents on issues that belong to the competence of the TO of the ESBU in Chernivtsi region.
• Checks for compliance with the legislation and international treaties of Ukraine draft orders and other documents submitted for signature to the head of TO of the ESBU in Chernivtsi region conducts legal examination of draft orders, orders, and provides conclusions based on the results of their consideration. Visas are granted to them in the presence of visas of other heads of structural subdivisions of TO of the ESBU in the Chernivtsi region.
• Checks draft letters and other documents that are submitted for signature to the head of TO of the ESBU in Chernivtsi region for compliance with current legislation.
• Examines draft orders on core activities, personnel issues, staffing, and orders of TO of the ESBU in the Chernivtsi region.
• Together with the structural divisions of TO of the ESBU in Chernivtsi region it reviews orders and other documents on issues that belong to the competence of TO of the ESBU in Chernivtsi region to bring them into compliance with legislation.
• Considers draft documents that have been received for approval on issues that belong to the competence of TO of the ESBU in Chernivtsi region and prepares proposals for them.
• Inform the head of TO of the ESBU in Chernivtsi region about the need to take measures to amend orders and other documents, recognize them as invalid, or cancel them.
• Considers and provides answers to applications, complaints, appeals of citizens, requests of individuals and legal entities, appeals and requests of people's deputies, and requests for obtaining public information by competence.
• Develop proposals for improvement of regulatory and legislative acts of the ministries and submit them to the ESBU in accordance with the established procedure.
• Contributes to the correct application of acts of labor legislation, and in case of non-fulfillment or violation of their requirements, submits a written opinion to the head of TO of the ESBU in Chernivtsi region with proposals for eliminating such violations.
• Makes suggestions to the head of TO of the ESBU in Chernivtsi region regarding the elimination of deficiencies in the legal provision of TO of the ESBU in Chernivtsi region, takes measures to implement the latest forms and methods of activity of the Sector.
• Provide legal advice to employees and managers of structural subdivisions of TO of the ESBU in Chernivtsi region regarding the correct application of legislation as well as clarification of the application of legislation during the performance of tasks and functional duties assigned to them.
• Provides legal advice to employees of TO of the ESBU in Chernivtsi region about their rights and freedoms the procedure for their implementation and restoration in case of their violation.
• Organizes the conduct of claims and lawsuits and court work, and supervises its conduct.
• Together with the interested structural subdivisions of TO of the ESBU in the Chernivtsi region, it develops draft contracts for the purchase of goods, works, or services, taking into account the features determined by the current legislation, and gives a legal assessment of the drafts of such contracts.
• Organizes work related to the conclusion of agreements (contracts), participates in their preparation and implementation of measures aimed at fulfilling contractual obligations, ensuring the protection of property rights and legal interests of TO of the ESBU in Chernivtsi region as well as approves (endorses) projects contracts with the approval (visa) of the heads of the interested structural units.
• Conducts together with the interested structural units, the analysis of the results of the economic activity of TO of the ESBU in Chernivtsi region, studies the conditions and causes of unproductive costs, violations of contractual obligations, as well as the state of receivables and payables.
• Analyzes the materials received from law enforcement and control bodies, the results of legal proceedings as well as statistical reporting data obtained as a result of inspections, audits, inventories, characterizing the state of compliance with the legality of TO of the ESBU in Chernivtsi region, prepares legal conclusions based on the facts of detected violations and participates in the organization of damage compensation work.
• Submit proposals to the head of TO of the ESBU in the Chernivtsi region about bringing to justice the employees who caused the damage due to their fault.
• Provides the Legal Sector of the ESBU with the necessary documents, information, references, reports on its activities, and other materials and also performs the tasks and assignments given by the Legal Sector of the ESBU in a prescribed manner.
• Performs other functions within the scope of competence, arising from the tasks assigned to the Sector.
